Dog Bite Injuries
The injuries inflicted by a dog can be extremely serious, leading to both emotional and physical scars. In addition to suffering injury from the bite itself, which may include deep lacerations and damage to muscle tissue and even bones, a victim may be pushed to the ground and therefore may suffer from head trauma or broken bones in the fall. Our goal is to fully analyze every angle of a client's case to determine the full extent of their injuries and therefore determine what their claim is truly worth. We look at current expenses as well as future losses the victim may experience, such as a diminished ability to perform the duties associated with his or her job, or lasting emotional trauma caused by physical scars or disfigurement. Every case is different, and you will find that when you work with a dog bite injury lawyer at our Los Angeles law firm, we will treat you individually and with compassion and professionalism. Strict Liability for Dog Bites in Los Angeles, California

One of the most important parts of a dog bite claim and of dog bite law in general is whether the state in which the attack occurred follows the "one bite rule." The one bite rule essentially allows a dog one "free" bite. Under this law, if an owner has no previous knowledge of a dog's aggressive behavior and the dog had not attacked anyone in the past, the dog owner cannot be held strictly liable in the event of a dog bite.

Fortunately, California does not follow the one bite rule and instead enforces strict liability on dog owners in the event of an attack. Even if a dog has no history of aggressive behavior and has not attacked anyone in the past, the owner may still be held liable for any injuries his or her dog causes in an attack. The only exception to strict liability in a Los Angeles dog bite claim may be if the victim was trespassing, provoked the dog, or was committing a crime at the time of the attack.

Financial Damages for Dog Bites

A person who has been injured by a dog may be able to seek financial compensation for his or her injuries. Most often, this compensation is covered by the dog owner's homeowners' insurance policy. If the dog owner does not have insurance, your attorney can look to other means for recovering the money you need for medical care, any lost wages from missed work, psychological trauma, and possibly more.

In some cases, criminal penalties may be enforced if a person purposefully trained a dog to be dangerous or ordered it to attack a person. It may even be viewed as a deadly weapon in this way. In addition to criminal charges that the dog owner may face, a victim of a dog bite may be able to file a civil suit to seek financial damages. In a situation involving intentional misconduct, punitive damages may also be awarded, although this will vary on a case by case basis.
